When do the new WHS laws come into effect?

WA’s Work Health and Safety legislation is not expected to come into force until January 2022. This means that the current occupational, mines safety and petroleum safety legislation still applies.

This information is designed to help WA organisations and their associated workforces (including volunteers) prepare for the new Work Health and Safety laws. More information will be added as it becomes available.

Will there be a transition period for businesses to adopt the new laws? 

Transitional arrangements will be in put into place where duties are new or substantially changed from existing requirements.

Part 16 of the WHS Act provides transitional periods for matters ranging from the terms of health and safety representatives (HSRs), to manufacture and imports.

The approach taken will be consistent with the transition principles agreed to by Safe Work Australia.
